This position is exempt under the Fair Labor Standards Act (FLSA) and serves at the pleasure of the Superintendent, in accordance with applicable Board policies and the Employee Handbook for Leadership Team Members.SUMMARYUnder the direction of the Chief General Counsel and Deputy Chief General Counsel, the Senior General Counsel represent the District in pending and active litigation, advises the District on legal matters, including interpretation of statues, case law, contracts, student rights, civil rights issues, human resources, labor relations, and other District-related legal issues, including the development, revision, and implementation of District policies and procedures. This position also assists in the oversight and coordination of the Administrative Investigations Division within the Office of the General Counsel; provides guidance, direction, and coaching to staff; and supports the effective administration and consistency of investigative processes and outcomes..EXEMPLARY DUTIES/RESPONSIBILITIES- Serves as a legal advisor and representative to the District through its duly authorized constituents: the Superintendent, the Board, and staff.- Conducts necessary legal research and answers a variety of legal questions regarding the legality of District actions and policies.- Conducts necessary legal research applicable to the issues facing the District.- Represents the District in hearings regarding suspensions/expulsions and other disciplinary actions regarding students.- Reviews District contracts.- Advises on potential strategies and settlement options.- Develops and maintains District due process procedures for employees, students, and members of the public.- Represents the District in labor negotiations, arbitrations, grievances, and complaint hearings, as well as employee-manager relations, Board actions, and other personnel matters as needed.- Represents the District, and eligible current and former employees and officers, in litigation brought in state and federal court, as well as administrative venues.- Conducts a program of preventative law for all departments and employees through program reviews, in-service training, and individual counseling sessions.- Provides legal assistance in the drafting of state legislation proposed by the school district for presentation to the Nevada State Legislature and/or the United States Congress.- Informs the Board of Trustees and Superintendent on the legal implications of pending legislation.- Ensures the District remains in compliance with applicable federal and state laws and implements strategies to reduce potential legal exposure.- Advises on board governance, including agenda development, meeting procedures, parliamentary rules, and policy adoption.- Assists in the development, revision, and implementation of district policies, regulations, and procedures.- Assists in supervising staff and overseeing the Administrative Investigations Division of the Office of the General Counsel.- May perform other duties as assigned.QUALIFICATIONSAny combination of education and experience that could likely provide the required knowledge and skills is qualifying.
